Family Law

The breakdown of a relationship is one of the most stressful events a person can go through. We provide clear, practical advice on your rights and obligations so that you can make sound decisions about your children, your property and your future.

Separation and divorce

You may apply for a divorce once you have been separated for at least 12 months. Divorce ends the marriage but it does not deal with property or arrangements for children. Those matters need to be resolved separately, and there are time limits for property applications after a divorce is finalised.

Property settlement

Property settlement involves identifying the assets, liabilities and superannuation of both parties, assessing the contributions each party has made, and considering the future needs of each party. Agreements can be formalised by consent orders or a binding financial agreement without the need to go to court.

Children

The best interests of the children are the paramount consideration in any parenting matter. We assist parents to negotiate parenting plans and consent orders covering where the children live, the time they spend with each parent and how major decisions are made. Where agreement cannot be reached, we advise and represent parents in the Federal Circuit and Family Court of Australia.

De facto relationships

Parties to a de facto relationship, including same-sex couples, generally have the same rights as married couples in relation to property settlement and children.
